It is important to understand that each individual survivor does not bring their own individual claim for wrongful death in the event of a loved one’s passing. In Florida, the probate court will appoint someone who is responsible for bringing all claims on behalf of the survivors if your loved one has not already chosen someone in his or her will. Typically, the surviving spouse or another relative is selected. This person is deemed the Personal Representative of the Estate.
