I think most of us when we think about a drunk driving accident we think about the driver running a red light, coming into the oncoming lane and injuring someone in the other car. This happens but it can also be a situation where the drunk driver just runs off the road and hits a tree or rolls the car over. In either situation, the drunk driver has caused the accident.
If someone is riding in the car with a drunk driver, they can have a claim against that driver even though they collided with another car or just hit a tree or rolled the car over. There’s a lot of variations on how this can work and it won’t work in every situation but it’s definitely something to keep in mind because the person in that situation very well may have a claim against the drunk driver or it might be an uninsured motorist claim if the drunk driver has no insurance.
