Who Can Bring a Wrongful Death Claim in Florida?

In Florida, we have a law which we call the Florida Wrongful Death Act. In this law the legislature describes very specifically who has the right to bring a claim to recover the damages or losses that they have suffered as a result of the death of their loved one.

Classically when someone dies their children, their spouse, their parents, other blood relatives and family members depending on the nature of the accident, and even in some situations, adoptive relatives can bring a claim and recover under the Wrongful Death Act.

Determining who can recover and what they can recover in Florida is very specific and it's one of those areas that I would urge you, if you're part of the family going through this terrible process, to consult with a lawyer at the earliest opportunity.
